*Tip of the month -- How did abortion become a private choice beyond the
law?
*Excerpts from /Fifty Questions on Abortion, Euthanasia and Related

The pro-life establishment, unfortunately, still mobilizes the troops to
fight for such marginal restrictions on surgical abortion as are
permitted by the Supreme Court. This effort is counterproductive because
it concedes that the intentional killing of some human beings can be
validly legalized and therefore that some human beings can be treated as
nonpersons. More important, surgical abortions are rapidly going the
way of the horse cavalry. In the new war, drugs and devices will
dominate as early abortion techniques. The establishment pro-life
movement, pre-occupied with band-aid restrictions on surgical abortion
and afraid to criticize contraception, is losing this new war by
default. One reason for this failure is that the pro-death forces, in a
pre-emptive strike more than three decades ago, succeeded in redefining
early abortion as contraception.
Joseph R. Stanton, M.D., of the Value of Life Committee, noted, "Until
1964 there was no scientific disagreement whatsoever that human
pregnancy began at fertilization ... Nor was there any dispute that
conception occurred at the time of the fertilization of the human ovum
by the human sperm ... Attempts to change the definition of the
beginning of pregnancy from the time of fertilization to the more ...
imprecise time of implantation began seriously in 1964 at the Second
International Conference on Intra-Uterine Contraception... This was a
... calculated effort to make induced abortion socially acceptable."
The American College of Obstetricians and Gynecologists (ACOG) committee
on terminology, in 1965, created new definitions of conception and the
beginning of pregnancy, relating them both to implantation rather than
fertilization of the ovum.
"In layman's terms," said Dr. Stanton, "this means that it was
anticipated that abortion would be more readily accepted by the American
public if it could be done at very early stages of pregnancy ...
Approval of 'drugs and devices intended to prevent implantation of the
fertilized ovum' would effectuate the sanctioning in the public law of
early induced abortion. Accepting the pragmatic redefinition of the
beginnings of human pregnancy as the time of implantation sets the stage
for acceptance of early self-administered abortion through the use of
drugs, prostaglandins, etc."
While the attention of the pro-life movement was focused on the effort
to ban partial-birth abortion, the Food and Drug Administration gave
final approval for the marketing of [mifepristone] . In September 1998,
the Food and Drug Administration approved marketing of [so-called]
"morning after" pills.
Other kinds of pills, approved for use in this country, are inaccurately
promoted as contraceptives although their effect is to prevent
implantation of the embryo in the womb.
Early abortion drugs and devices could remove abortion from the
political agenda since they are defined as contraceptive rather than as
abortifacient. Early abortifacients are beyond the effective reach of
the law. It will usually be impossible to prove that a life was
terminated in an early abortion; prosecution for abortion therefore
would be practically impossible. The legal obliteration of the
distinction between contraception and abortion has put chemical
abortions beyond the practical reach of the law.
