*Sample Letter sent to Ohio reps and senator 10/29/09:*
Hello:
I am asking you as my House (Jordan) and Senate (Harris) represenatives,
and as a fellow pharmacist (Dave) to vote against any further progress
of the twin Ohio bills HB 293 and SB 176. They are anti-pharmacist and
intolerant/bigoted towards those with religious, moral and conscientious
objections to drugs and devices that harm our patients, no matter how
small, no matter what their stage of biological development.

Here is a quick analysis by Dr. Kristine Severyn, PhD, RPh, from Dayton, OH:
When you have the chance to read the bill, you'll find some scary stuff for pharmacists.
Ohio HB 293:
1. "Access to contraceptives in pharmacies" (RC 4729.43(A) to (D)
"If a customer of a pharmacy requests a contraceptive [sic] that is in stock, the bill requires the pharmacy to ensure that the contraceptive is provided to the customer without delay." (Goes on to describe what this means, and what they should do if they don't have it, etc.)
2. "Remedies and enforcement" (RC 4729.16 and 4729.44)
If a "violation" has occurred, persons are permitted to file a complaint with the State Board of Pharmacy. NLT 30 days after the complaint is received, the Board must investigate. If violation occurred, pharmacist may be fined not more than $5,000 for each violation.
The bill also permits civil action against the pharmacist by the "injured" person.
The Ohio Attorney General also can bring action against the pharmacist, which may "include compensatory damages and punitive damages not exceeding $5,000 for each violation."
"[Ohio] State Board of Pharmacy disciplinary actions: If a pharmacist or pharmacy intern fails to comply with the bill's provisions on access to contraceptives in pharmacies, the bill permits the Board to use its existing authority to take disciplinary actions relative to the individual's license to practice pharmacy. As specified in existing law, the Board may revoke, suspend, limit, place on probation, or impose a monetary penalty or forfeiture..."
"Emergency Contraception" (RC 3727.60 and 3727.601(A), (B), and (D)(1)
Hospital must provide victims of sexual offenses with "medically and factually accurate, unbiased, and clear and concise [sic] written and oral information about emergency contraception. Bill specifies that the information must explain several points, including:
"That emergency contraception does not cause an abortion and studies have shown that it does not interrupt an established pregnancy." [Both these statements are unscientific and patently false.]
This bill will not only affect pharmacists, but physicians' [rights of religion, morals and conscience].

Dave Burke commented on his status:
"We had sponsor testimony on this bill in Health Committee. I have read the bill and reached the same conclusion. It will put us one step away from forcing pharmacists to dispense these types of prescriptions. While it does not directly attack the moral Right to Life issue, I hope the pro-life folks would engage in the process via opposition testimony. You and other pharmacists should also consider giving opponent testimony.
I am no more comfortable dispensing this type of medication than telling someone where to get it. In my mind, I am still assisting in murder. If I hand out directions to an abortion clinic, but never work at the clinic am I absolved? On a retail trade level, when is a business legally responsible to send a customer to a competitor based on business practice? Accordingly, should a merchant engage in such services, they should promote it rather than build law that forces engagement of merchants who by choice do not supply such products.
If we truly believe life begins at conception, regardless if implantation has occurred, then a negative pregnancy test does not matter. Once life is created it is simply created. Any course that affects that outcome is at a minimum assisting in abortion in my view. Directing a patient to another provider is parallel to dispensing. As much as I disagree with dispensing these medications, I am unaware of limitations to it based on access to supply. For these reasons, I do not support the bill."

As Canada's Parliament debates Bill C-384, why are more pharmacists not
rising up in protest over possible legalization of euthanasia and
assisted suicide? Is it because we ought to remain neutral? Yet if this
debate is supposed to be all about choice, then, as a pharmacist, I
choose not to remain neutral on an issue that could impact my livelihood.
I'm in the business of health and wellness; longevity concoctions, my
specialty. I believe it is more lucrative to keep my oldies alive and
kicking longer; eliminating them is against my mission statement, and it
would surely kill my business too. Unless, of course, I could charge a
hefty sum for how-to-exit kits, including arsenic, asphyxiation bags,
and other death paraphernalia.
But then comes another dilemma; as the elderly get knocked off,
replacements will be needed -- so I can continue to offer my services.
Yet most pharmacies are also in the birth control business; sooner
rather than later, my clients will largely come from overseas. Time to
brush up on my Arab and Cantonese...[cont'd at link above].
