*Matt Bowman: Barrie Hussein Obama's newly proposed HHS conscience
rule blatantly refuses to implement the law*

By Matt Bowman, Esq.
Alliance Defense Fund Legal Counsel

Today the Obama administration published its proposal to completely
rescind and eliminate the conscience-protecting regulations that the
Bush administration passed in January. The "proposed rescission" is
here: Rescission of the Regulation Entitled "Ensuring That Department of
Health and Human Services Funds Do Not Support Coercive or
Discriminatory Policies or Practices in Violation of Federal Law";
Proposal, 45 CFR Part 88.
<http://www.federalregister.gov/inspection.aspx#special> (Direct link:
pdf download of the proposed regs
<http://www.alliancealert.org/2009/20090306.pdf>)

Contrary to media reports
<http://www.washingtonpost.com/wp-dyn/content/article/2009/02/27/AR2009022701104_2.html>
by anonymous Obama officials, President Obama is not proposing to
narrowly tailor the regulations or better define them, nor will he leave
in place regulations to protect doctors from being forced to participate
in at least some surgical abortions. /He will "rescind in its entirety"
the current regulation/, leaving no federal regulation at all protecting
doctors, even from being forced to participate in such things as
late-term abortion.

As explained here before
<http://www.alliancealert.org/2008/11/26/matt-bowman-on-conscience-protection-for-health-care-providers-who-threatens-the-status-quo-bush-or-obama/>,
the current implementing regulation does nothing more than take laws
that have been on the books for three decades, and actually enforce
their words so that federal fund recipients cannot illegally
discriminate against pro-life health care workers. The implementing
regulations in no way expand those time-honored laws---they simply
enforce them, so that the will of the American people would actually
be applied to protect doctors from being forced to participate in
abortions or face dire consequences.

By his rule issued today, President Obama is utterly refusing to enforce
these conscience protection laws, resulting in a situation where doctors
may be forced to participate in abortions and patients may be forced to
have their babies delivered by doctors who perform abortions. Whatever
happened to the so called "right to choose"? The Obama administration is
quite simply collaborating with Planned Parenthood and their allies to
allow pro-life medical professionals to be punished for their
beliefs, with the punishment to be funded by your federal dollars.

Americans can object to this attack on religious freedom by sending a
polite but direct email to proposedrescission at hhs.gov
<mailto:proposedrescission at hhs.gov> asking that the existing regulations
be maintained, but they must send their email within the next 30 days.

*Obama to Sign Executive Order Monday Opening Public Funding of
Embryonic Stem Cell Research*

By John-Henry Westen

WASHINGTON, March 6, 2009 (LifeSiteNews.com) - President Barack Obama
plans to rescind the Bush policy limiting federal funding for embryo
destructive research on Monday. The Bush policy had allowed federal
funding for experiments on already existing lines of embryos, but
forbade the funds from being used to create new embryos for
experimentation.

According to news reports, a signing ceremony will take place on Monday
at 11 am. Details about the Executive Order are not available, but
according to the Washington Post, "proponents expect Obama will simply
lift the restriction without caveats and let the NIH work out the details."

Tony Perkins, President of Family Research Council commented on the
news, saying, "Today's news that President Obama will open the door to
direct taxpayer funds for embryonic stem cell research that encourages
the destruction of human embryos is a slap in the face to Americans who
believe in the dignity of all human life."

Perkins added: "I believe it is unethical to use human life, even young
embryonic life, to advance science. While such research is unfortunately
legal, taxpayers should not have to foot the bill for experiments that
require the destruction of human life."

The Family Research Council leader pointed out that "Obama's policy
change is especially troubling given the significant adult stem cell
advances that are being used to treat patients now without harming or
destroying human embryos."

He concluded, "Despite the significant advances using adult stem cells
to treat patients, and new techniques to create stem cells from any
patient, President Obama will choose to direct taxpayer's money to
experiments that represent the poorest stem cell science.

Just this week ten pro-life Members of Congress spoke on stem cell
research during a Special Order organized by Rep. Chris Smith (R-NJ).
Smith and the other pro-life Congressman observed that embryonic
stem-cell research is not only unethical, but unnecessary, given the
superior results achieved through adult stem cell research.

"Human embryo-destroying stem cell research is not only unethical,
unworkable and unreliable, it is now demonstrably unnecessary," said
Smith. "Adult stem cells ... are truly remarkable. They work, they have
no ethical baggage, and advances are made every day at a dizzying pace.

But despite so much progress in the adult stem cell field, "the Obama
administration and the House and Senate Democratic leadership remain
obsessed with killing human embryos for experimentation at taxpayer
expense," said Smith.
